Terms of Service

These Terms of Service (“Terms”) govern your use of PerthStage AI, a virtual staging service operated from Western Australia, Australia (“we”, “us” or “PerthStage AI”).

By creating an account or using our services, you agree to be bound by these Terms. If you do not agree, do not use our services. These Terms form a binding agreement under Australian law.

PerthStage AI is a listing production tool for real estate agents. The service accepts photographs of empty or lightly furnished rooms and produces digitally staged images suitable for use in real estate listings on Domain, realestate.com.au and similar Australian property portals.

PerthStage AI is not an interior design service, an AI image generator for general use, or a substitute for photographic or professional staging advice. It is designed exclusively for real estate listing production.

You must create an account to use PerthStage AI. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must provide accurate information when registering.

Accounts are for individual agents or single business entities. You may not share account access with multiple people unless you are on a plan that explicitly permits it.

New accounts receive two (2) free staging credits on signup, with no credit card required. This is enough for one complete staging generation. Credits expire if not used within 90 days of account creation. We do not offer free trials of paid subscription plans.

Paid subscriptions are billed monthly in advance in Australian Dollars (AUD) via Stripe. By subscribing, you authorise Stripe to charge your payment method on a recurring monthly basis until you cancel.

Subscription prices are shown inclusive of any applicable Australian taxes. We will provide a tax invoice on request. Prices may change with 30 days notice.

You can manage, upgrade, downgrade or cancel your subscription at any time through your billing portal. Changes take effect at the start of your next billing cycle. Cancellation takes effect at the end of the current billing period — you retain access to your credits until then.

Each subscription plan includes a set number of staging credits per billing cycle. Two credits = one staging generation (one listing-ready image output). Credits reset at the start of each new billing cycle. Unused credits do not roll over to the following cycle.

Credits are deducted when a staging generation is submitted. If a generation fails due to a technical error on our end, the credit will be automatically refunded to your account.

Credits have no monetary value and cannot be transferred, sold or redeemed for cash.

All subscription payments and credit purchases are final and non-refundable. By subscribing you acknowledge that you have had the opportunity to evaluate the service using the free credits provided to every new account before committing to a paid plan.

Monthly subscription fees are non-refundable once the billing cycle has begun, regardless of how many credits have been used. Unused credits at the end of a billing period do not carry over and hold no monetary value.

The only exception is a technical failure: if a generation fails due to an error on our end, the credit consumed is automatically restored to your account. This is a credit restoration, not a cash refund.

If you have a billing dispute, contact support@perthstageai.com.au. We will investigate technical failures and restore credits where warranted, but we do not issue cash refunds.

You agree to use PerthStage AI only for lawful purposes. You must not:

• Upload images you do not have permission to use for virtual staging
• Use staging outputs to misrepresent the physical condition of a property
• Attempt to circumvent billing, access controls or rate limits
• Use the service to generate images that are misleading, fraudulent or illegal
• Attempt to reverse-engineer or extract our AI models, prompts or pipelines
• Use automated scripts to submit bulk generation requests beyond plan limits

Australian real estate agents have obligations under consumer protection legislation not to mislead buyers. Virtual staging alters the visual presentation of a property and must be disclosed wherever the image is published.

Every staged image produced by PerthStage AI includes a disclosure note. You are responsible for ensuring this disclosure appears in all listings, marketing materials and portals where the image is used. PerthStage AI is not liable for any failure to disclose virtual staging in your listings.

PerthStage AI does not alter walls, floors, ceilings or permanent fixtures. Only furniture, soft furnishings and décor are added. This is reflected in the disclosure note included with every output.

You retain ownership of all images you upload. You grant PerthStage AI a limited licence to process your images solely for the purpose of delivering the staging service.

The staged output images are yours to use for your real estate listing purposes, subject to proper disclosure of virtual staging. PerthStage AI retains no rights over your output images once delivered.

PerthStage AI, its brand, software, prompts and AI pipelines are proprietary and may not be copied, scraped or reproduced.

PerthStage AI is provided “as is” without warranties of any kind, express or implied. We do not guarantee that outputs will be suitable for every listing, portal or use case.

To the maximum extent permitted by Australian law, our total liability to you for any claim arising out of these Terms or your use of the service is limited to the amount you paid to us in the 3 months preceding the claim.

We are not liable for indirect, consequential or incidental losses, including loss of commission, loss of data or loss of business opportunity arising from use of the service.

We aim to maintain high availability but do not guarantee uninterrupted service. We reserve the right to perform maintenance, update pricing, change features or discontinue the service with reasonable notice. In the event of a discontinuation, we will provide at least 30 days notice.

We reserve the right to suspend or terminate accounts that breach these Terms, engage in fraudulent activity, or create technical or security risks. If we terminate your account due to a breach, no refund will be issued.

You may close your account at any time by contacting support or through your account settings. Account closure does not entitle you to any refund or credit restoration.

These Terms are governed by the laws of Western Australia and the Commonwealth of Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Western Australia.
